What is probate?
Probate is the formal legal process used to transfer ownership of a deceased person’s assets to their designated heirs, often decided in court.
The hope is that you have an estate plan in place that prevents your family from having to make decisions via probate.
Probate is a public case in district court. The recipients of your estate are determined either by state law (if you don’t have a will) or by the terms of your will if it is proven to be valid in court. This process is required to transfer the title of assets that you own in your individual name at the time of your death.
It can be a lengthy and expensive process. We will be by your side every step of the way.
Note: Court filings, asset distribution, and stressed family members make probate an emotionally and financially taxing process. If you are not yet in a situation that requires probate, we highly recommend you put an estate plan in place to help you forgo probate.
